Anna Dwyer is a patent trial lawyer and partner of Blue Peak Law Group. Ms. Dwyer has extensive experience representing some of the largest companies in the world in high-stakes patent matters in district courts, the Patent Trial and Appeal Board, the International Trade Commission, and the Federal Circuit. Her practice spans a wide range of technologies, including small molecule and biologic pharmaceuticals, methods of treatment, formulations, polymorphs, medical devices, DNA sequencing, sonar and electrical engineering technology.
Ms. Dwyer has played a lead role in all phases of litigation, from pre-suit investigation, to case management and strategy, Markman briefing and hearings, witness preparation, presentation and examination at trials, oral arguments, and briefing on appeal. She has taken and defended numerous fact and expert depositions, and has played an active role in numerous bench and jury trials. Ms. Dwyer has also counseled and advised clients on patent diligence for IP transactions.
Prior to joining Blue Peak Law Group, Ms. Dwyer was a Counsel at Weil, Gotshal & Manges.

vCard: Kate Falkenstien
Kate Falkenstien is a trial lawyer and partner of Blue Peak Law Group. Her trial and litigation practice spans a broad range of disputes, including patents, trade secrets, and complex commercial litigation. Ms. Falkenstien is based in Boise, Idaho, but she has nationwide experience, including litigation in federal courts in California, Delaware, Texas, Georgia, Pennsylvania, and Illinois, as well as related matters in Delaware Chancery Court and appeals in the Ninth and Federal Circuits. She also has significant pro bono experience representing incarcerated plaintiffs challenging prison conditions.
Ms. Falkenstien represents both plaintiffs and defendants with an efficient and analytical approach that aims to find practical solutions for her clients. Experienced across all phases of litigation, Ms. Falkenstien particularly enjoys brief writing, oral argument, and damages analysis. Her work has led to significant jury trial victories, including 8- and 9-figure patent damages awards. Ms. Falkenstien has been recognized by Benchmark Litigation as a “Future Star” in its 2022 and 2023 rankings.
Before joining Blue Peak Law Group, Ms. Falkenstien was a partner at Reichman Jorgensen Lehman & Feldberg LLP. She has also been an associate at McKool Smith and a law clerk to Judge Sri Srinivasan on the D.C. Circuit. Ms. Falkenstien is a graduate of Stanford Law School, where she was a Kirkland & Ellis Scholar, an honor awarded to the top student in each small section. She received her undergraduate degree from Yale University, where she was named the top speaker at the national debate championships.

vCard: Richard Koehl
Richard M. Koehl, Ph.D., is an intellectual property litigation attorney and a partner of Blue Peak Law Group. Dr. Koehl has deep experience in all aspects of patent litigation as counsel for both plaintiffs and defendants. Contentious matters involving trademarks, trade dress, trade secrets, and intellectual property contracts have also been a prominent part of his practice.
Dr. Koehl was co-counsel for the petitioner in TC Heartland LLC v. Kraft Foods Group Brands LLC, 137 S. Ct. 1514 (2017), a widely-reported U.S. Supreme Court patent venue case. He has also appeared in district courts around the country, in inter partes review proceedings, and in appeals at the Federal, Second, and Third Circuits and the U.S. Supreme Court. He is admitted to the bar in Texas and New York.
Dr. Koehl is familiar with a variety of industries and technlogies. He graduated from Rice University in 1995 with a B.A. in chemistry. Before law school, he earned his Ph.D. from M.I.T. in 2000 for his work concerning spatial and temporal ultrafast imaging and control of terahertz wave packets, for which he received a patent.

Robert Magee is a trial lawyer who specializes in intellectual property and technology issues. Mr. Magee has litigated cases on behalf of plaintiffs and defendants across a variety of technologies and in nationwide venues, including District Courts in California, Delaware, Florida, Minnesota, New York, North Carolina, and Texas, the Federal Circuit, the International Trade Commission, and the Patent Trial and Appeal Board.
Mr. Magee is also experienced in intellectual property licensing and patent portfolio analysis. He has advised clients in support of portfolio acquisitions, mergers and acquisitions, and adverse negotiations.
Additionally, Mr. Magee has also taken on a variety of pro-bono clients. He has litigated against the California penal system to defend prisoner rights. Robert has helped refugees seek asylum and parents of disabled children obtain conservatorships. He has also advised educational non-profit organizations on governance and technology issues and worked with Oscar-winning documentarians on copyright and trademark issues.

Jeff Risher has been an intellectual property litigator and strategist for more than two decades. His experience includes dozens of patent, trademark, copyright, and trade secret trials and appeals throughout the U.S. (including numerous matters before the U.S. International Trade Commission and the Federal Circuit) and around the world, including China, Japan, Germany, United Kingdom, The Netherlands, Australia, Italy, Portugal, Spain, Belgium, Brazil, and Mexico.
Mr. Risher has a unique understanding of the business complexities of patent litigation from the client perspective, having spent more than a decade overseeing complex litigation and licensing matters at major global technology companies, including Apple, where he served as Director of Patent Litigation and as Director of Patent Strategy & Licensing, and Tesla, where he served as Chief IP Counsel and as Chief Litigation Counsel. In addition, Mr. Risher served as Patent Litigation Counsel at Abbott Laboratories, where he was responsible for medical device, immunology and pharmaceutical patent cases, as well as six years as a trial lawyer at two major Southern California law firms, with a focus on medical devices, prior to his in-house career.
Mr. Risher has represented public technology companies in many dozens of high-stakes mediations and arbitration proceedings, and he regularly advises clients on IP strategy, patent portfolio development, licensing, patent acquisitions, strategic relationships, technology transfers and joint development deals. He has personally negotiated and drafted in excess of 100 patent licenses, cross-licenses and patent purchase agreements between some of the most sophisticated technology companies in the world, and was honored to have been recognized by Intellectual Asset Management Magazine (IAM) as one of the “World’s Top IP Strategists,” based on industry peer nominations.

Mr. Stephens is a registered patent attorney with the United States Patent Office and has been lead counsel in numerous inter partes review and ex parte reexamination proceedings. Before founding Blue Peak Law Group, Mr. Stephens was (at different times) a senior partner at Weil Gotshal & Manges LLP, the managing principal of the Houston office of Fish & Richardson P.C., and a partner at Pennie & Edmonds LLP.
Mr. Stephens is committed to pro bono practice. He is especially proud of his representation of Sherwood Dewayne Brown who was exonerated after spending more than 26 years on Mississippi’s death row for murders that he did not commit.
