Kate Falkenstien is a trial lawyer and partner of Blue Peak Law Group. Her trial and litigation practice spans a broad range of disputes, including patents, trade secrets, and complex commercial litigation. Ms. Falkenstien is based in Boise, Idaho, but she has nationwide experience, including litigation in federal courts in California, Delaware, Texas, Georgia, Pennsylvania, and Illinois, as well as related matters in Delaware Chancery Court and appeals in the Ninth and Federal Circuits. She also has significant pro bono experience representing incarcerated plaintiffs challenging prison conditions.

Ms. Falkenstien represents both plaintiffs and defendants with an efficient and analytical approach that aims to find practical solutions for her clients. Experienced across all phases of litigation, Ms. Falkenstien particularly enjoys brief writing, oral argument, and damages analysis. Her work has led to significant jury trial victories, including 8- and 9-figure patent damages awards. Ms. Falkenstien has been recognized by Benchmark Litigation as a “Future Star” in its 2022 and 2023 rankings.

 

Before joining Blue Peak Law Group, Ms. Falkenstien was a partner at Reichman Jorgensen Lehman & Feldberg LLP. She has also been an associate at McKool Smith and a law clerk to Judge Sri Srinivasan on the D.C. Circuit. Ms. Falkenstien is a graduate of Stanford Law School, where she was a Kirkland & Ellis Scholar, an honor awarded to the top student in each small section. She received her undergraduate degree from Yale University, where she was named the top speaker at the national debate championships.

  • Densify, Inc. v. VMware, Inc. (D. Delaware): trial counsel for Densify, securing a $236 million patent infringement verdict

  • Droplets, Inc. v. Yahoo!, Inc. (N.D. California): trial counsel for Droplets, securing a $15 million patent infringement verdict

  • In re Altaba, Inc. (Delaware Chancery): lead counsel for Droplets, a claimant in Altaba’s dissolution proceedings, obtaining a reservation of assets to cover Droplets’ patent infringement litigation

  • Arconic, Inc. v. UAC, Inc. (N.D. Georgia): counsel for Arconic in trade secrets litigation regarding aluminum manufacturing techniques for airplane manufacturing

  • Arconic, Inc. v. Novelis, Inc. (W.D. Pennsylvania): counsel for Arconic in trade secrets litigation about aluminum processing for automotive manufacturing
